AGREEMENT TO OUR LEGAL TERMS

We are Aero Maritime Club ("Company," "we," "us," "our"), a company registered in Florida, United States.

We operate the website [Insert Website URL] (the "Site"), as well as any other related products, services, or platforms that refer or link to these legal terms (collectively, the "Services").

Aero Maritime Club offers a premium, professionally managed fractional co-ownership platform for luxury day-boating. Under our model:

  • We curate and source premium vessels.

  • We structure a dedicated property LLC for each vessel.

  • We select and match up to four (4) co-owners per boat, each holding a 25% ownership share.

  • We professionally manage all sales logistics, scheduling, and ongoing operational management (including maintenance, storage, slip fees, and insurance) which are bundled into a predictable monthly contribution.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Aero Maritime Club, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms.

IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

1. OUR SERVICES

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to local law or regulation.

Important Note: These Website Terms & Conditions govern your use of this digital platform. Actual vessel co-ownership, LLC membership, scheduling rights, and operational costs are strictly governed by a separate, bilateral Aero Maritime Club Co-Ownership & Operating Agreement executed individually by each co-owner.

2. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

  1. All registration or inquiry information you submit will be true, accurate, current, and complete.

  2. You will maintain the accuracy of such information.

  3. You have the legal capacity and agree to comply with these Legal Terms.

  4. You are at least 18 years of age.

  5. You will not use the Services for any illegal or unauthorized purpose.

3. CO-OWNERSHIP INQUIRIES & REGISTRATION

To explore fractional co-ownership opportunities, you may be asked to submit an inquiry form or register an account.

  • Confidentiality: You agree to keep any account passwords or access details confidential.

  • Vetting: Submission of an inquiry or application on the Site does not guarantee acceptance into an Aero Maritime Club ownership group. We reserve the sole right to vet and approve all potential co-owners to ensure a premium, harmonious club community.

4. INTELLECTUAL PROPERTY RIGHTS

Our Intellectual Property

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, website designs, audio, video, text, photographs, branding, and graphics (collectively, the "Content"), as well as our trademarks and logos (the "Marks").

Your License to Use the Site

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services solely for your personal, non-commercial use in evaluating our fractional boat ownership programs. No part of the Services, Content, or Marks may be copied, reproduced, or exploited for any commercial purpose without our express prior written permission.

5. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:

  • Systematically retrieve data or content to create or compile a database or directory.

  • Circumvent, disable, or interfere with security-related features of the Site.

  • Disparage, tarnish, or otherwise harm, in our opinion, us, our brand, or our vessels.

  • Use the Services in a manner inconsistent with any applicable laws or regulations.

  • Attempt to impersonate another user or use another user's credentials.

6. LIMITATIONS OF LIABILITY & DISCLAIMERS

The Site and its content are provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, Aero Maritime Club disclaims all warranties, express or implied, in connection with the website.

In no event will Aero Maritime Club, its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, or punitive damages arising from your use of the website platform.

7. GOVERNING LAW

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action arising out of these terms shall be filed in the state or federal courts located in Lee County, Florida (or Collier County, Florida, as applicable).
